General Terms of use
This web site is owned and operated by ATS Company and is made available to you on the following terms and conditions. By using the site and the services available on it you are deemed to accept these terms and conditions and any additional terms and conditions which expressly apply to services and information provided by third parties.
Use of the Website
The information and services available on the site are provided for the sole purpose of individuals looking for employment opportunities and career information and for employers seeking to recruit staff. You may use, print and download information from the site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, display, transmit or distribute any material from the site
‘WE’, ‘US’ or ‘our’ are references to ATS or www.atshr.com
"Client’ or "Partner" means any company, organization or firm which purchases services.
(‘Services’-means all recruitment & advertisement products and services made available by us) from us.
Prices for Advertisements through our ATS
Prices for a certain period will be as per subscription Application class, so if client wants to advertise a job post on www.atshr.com, it will remain live for certain period of time he/she desires and selects on the web. Any extension of this time will be charged to the Subscriber as a new posting.
The fee stated on the subscription Application Form (as may be amended from time to time).
Prices for using our CV-search engine of Job seekers:
Price for using our CV (Job seekers) Search engine (website) Packages are also fixed to all Clients who wish to use the CVs Database and described on the web.
Termination
The Advertiser may not terminate the provision of Services under any Purchase Order. Termination of subscriptions may be negotiated at our discretion and can result in loss of discounts or other paid amounts.
We may terminate the provision of Services if:
The Employer / Advertiser is in material breach of these terms and conditions and has not remedied such breach within 48 hours of notice specifying the breach and requiring that it be remedied, or:
The Employer / Advertiser become insolvent, ceases to trade or goes into liquidation.
Job Advertisements posted on www.atshr.com may also appear on third party recruitment web sites pursuant to agreements from time to time between ATS and the proprietors of such web sites.
Use of Job Seekers CVs Database:
Employers, Employment agencies and Employment Businesses, if you are any type of employer, employment agency or an employment business; it is your responsibility to ensure that the use you make of information from our job seekers database is for the sole purpose of direct use to your own organization. You agree to comply with the Act and any other applicable laws and regulations as they affect the conduct of your business and the use you make of information on our job seekers database.
You may NOT:
Supply, sell or license material from job seekers database, or a copy of it, to any other person, including another member of your group of companies.
Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidate for specific job vacancies. You must, at all times, comply with the Data Protection Act 1998 and all subsequent legislation and regulations.
Dealing with Job Seekers
You agree to deal fairly and professionally with Job Seekers you may contact using information from the job seekers database and not do anything which may bring ATS into disrepute.
Online Advertising
The Services shall commence on the “Subscription Application Form” which shall be defined as the date both parties agree that the content on the site is satisfactory.
The fee shall be payable upon online intimation by ATS before the activation of the service. In principle, all payments are in advance through Internet.
The Services shall comprise access to the purchased service, as requested; the client shall provide any information or copy promptly. The client shall use reasonable endeavors to ensure the truth and accuracy of information supplied by the Advertiser. The Employer/Advertiser understands that to the extent that any additional Services are offered to it, ATS may charge for these additionally.
www.atshr.com may issue a unique password to the Advertiser. This password shall not be transferred or misused under any circumstances. If for any reason, a third party has gained unauthorized access to your account, please contact ATS immediately.
Both parties shall observe obligations under the Date Protection Act 1998 and any other privacy laws. Where the job seeker sends information through to the Advertiser, the information should only be used for the express purpose in which it was sent.
ATS cannot guarantee the accuracy of any information which the Client obtains or is sent through its use of the Website. ATS can not accept any liability for any:
Loss arising from information inputted, received, available at, linked to or removed from the Website howsoever occurring.
Special, indirect or consequential loss, including, without limitation, loss of information, profit, contract, anticipated savings or opportunity, Interruption to the Services or access to the Website as a result of events beyond our reasonable control.
Managed Account Service “MAS”
ATS has the right to accept or reject certain positions based on availability or for any other reason.
ATS has the right to use other recruitment sources apart from ATS to find and verify candidates by phone.
For Managed Accounts with no subscriptions, Successful Completion of the service means that ATS has forwarded certain numbers of relevant CVs per position during the subscription period regardless if the employer manages to recruit or not.
Failure to provide the employer with a certain relevant CVs during the Subscription period entitles that ATS extends the subscription for the same period free of charge with no refund.
Refund only applies if ATS falls to deliver after 3 months of free extension. Refund is limited to the number of non-served positions only.
Refund doesn’t apply to any Regular Subscription Package an only applies to non-served Managed Accounts per Position during the subscription period
A position is a unique job Title e.g., (A Sales Representative) are considered two different positions just like Sales Manager as on position and Mechanical Engineer as another position.
Miscellaneous terms:
These Terms may be change by us at any time. You should regularly check for updates in these Terms as you will be deemed to accept the Terms (as amended) when you next use the Website following any amendment.
Headings are inserted in this Agreement for ease of reference only and not form part of it for the purposes of interpretation.
Failure by us to exercise or enforce any rights conferred by the Terms or at law shall not be deemed to be a waiver of any such right nor operate so as to bar the exercise or enforcement thereof at any time o times thereafter.
If any provision of this Agreement is determined to be illegal or unenforceable by any court of competent jurisdiction it shall be deemed to have been deleted without affecting the remaining provisions.
ATS reserves the absolute right, without giving any reasons, to decline, cancel or remove any advertisement or provision of Services for any reason and at any time without prior notice.
For Employers/Advertisers: each Subscription is for a single organization only as included in your registration information. On registration, you will be allocated a user name and password (“ACCOUNT”). You may choose to authorize your employees (together “Users”) to use you ACCOUNT whilst carrying out the business of you organization. You are responsible for all use of the Services by all such Users and anyone else using your ACCOUNT and for preventing unauthorized use of your ACCOUNT.
Governing law
These terms and conditions shall be interpreted in accordance with GCC law and all disputes shall be decided by the GCC courts.
